A federal judge in the Northern District of Texas struck down all but one of the April 2024 marketing provisions in the rule, which had been paused by a lawsuit last year. The provision continues to ban third-party marketing firms from distributing personal beneficiary data, such as names, addresses, and phone numbers, to other marketing organizations without consent.
At this time, there’s no indication whether the federal government will appeal the ruling to continue this case. Agility expects the current CMS-approved Medicare Advantage agent compensation structure to continue through 2026, unless further court activity alters it as a result of this case.
