Agility is informing ACA agents of an opportunity to provide direct feedback to CMS on new ACA marketplace rules. The proposed Notice of Benefit and Payment Parameters for 2027 is open for public comment for 30 days.
You may submit electronic comments on this regulation until March 11, 2026, by following the “Submit a comment” instructions at http://www.regulations.gov. Here are some key points from the proposed Payment Notice for 2027:
- The proposed rule reinforces CMS’s authority to investigate, suspend, and terminate agents for their conduct.
- The proposed rule expands CMS’s authority to take action against agency principles.
- Agents and brokers must use a consumer consent form created and approved by HHS to meet eligibility application review and documentation requirements.
- The proposal would set stronger standards for how agents and brokers market their services, including clear examples of prohibited marketing practices.
- The vendor program, which lets HHS-approved vendors offer annual Marketplace agent and broker training, would be discontinued.
CMS is publishing the proposed rule on February 11, 2026. CMS’s proposal outlines numerous planned changes to ACA agent activities in 2027.
