A federal Judge from the US District Court of Maryland is temporarily blocking several provisions of the 2027 CMS ACA Final Rule as part of a June federal lawsuit filed by 4 cities and counties across the nation, Doctors for America, and the Main Street Alliance. Judge Brendan Hurson ruled the plaintiffs were likely to succeed on the merits of their challenge to certain provisions in the rule and that the plaintiffs would suffer irreparable harm from these rules.
In his ruling, the judge paused 8 provisions, including the expanded hardship exemption, revised network adequacy standards, the methodology for updated bronze plan cost shares, and the elimination of the need to standardize Marketplace plans. At this point, there’s no indication of what the next steps will be in the lawsuit, including any appeals or hearing dates about the merits of the case.
