What Agents Need to Know About New 2027 CMS Medicare Sales Rules

With the start of AEP less than a week away, one reality for Medicare agents is that this selling season comes with another round of compliance details to learn. For 2027, though, some of the changes from the Centers for Medicare & Medicaid Services (CMS) actually simplify parts of the sales process.

CMS finalized changes intended, in part, to remove restrictions on when and how Medicare beneficiaries speak with licensed agents and brokers. That doesn’t mean Medicare sales have suddenly become a compliance-free-for-all.

Here is what agents should have on their radar heading into the 2027 selling season.

The 48-Hour SOA Waiting Period Is Gone

This is one of the biggest practical changes. CMS’s 2027 Agent and Broker Training and Testing Guidelines state that the 48-hour waiting period between completion of a Scope of Appointment (SOA) and a personal marketing appointment has been removed.

That makes scheduling much easier. Instead of asking an interested beneficiary to complete an SOA and then potentially waiting two days to continue the conversation, agents have more flexibility to move forward when the beneficiary is ready.

But don’t confuse removing the waiting period with removing the SOA. The SOA is still required for personal marketing appointments.

CMS also specifies that an SOA must be in writing for in-person marketing appointments.

Even Beneficiary-Initiated Conversations Require an SOA

CMS’s 2027 guidance explains that an SOA is required whether the conversation was initiated by the agent or by the beneficiary. That includes situations such as walk-ins, unscheduled calls, web-based chats, and web forms when the interaction becomes an individualized or small-group conversation involving Medicare marketing topics.

A Medicare beneficiary calling you doesn’t mean you don’t need an SOA. Agents must make collecting an SOA part of their normal processes, making it a routine procedure rather than something you only remember halfway through the conversation.

Educational Events Have More Flexibility

For 2027, CMS says agents may collect SOA forms at an educational event. CMS also removed the previous 12-hour delay between an educational event and a marketing event at the same location.

A marketing event may follow, as long as beneficiaries are clearly told that the educational event is ending and that the marketing event will begin shortly, and that there is sufficient opportunity for people to leave before the marketing begins. That creates a much cleaner path from education to an optional sales conversation without pretending the two activities are the same thing.

Call Recording Hasn’t Disappeared

CMS hasn’t backed away from documentation. Organizations and TPMOs operating on their behalf must ensure that marketing, sales, and enrollment calls are recorded in their entirety, including the audio portion of calls conducted through web-based technology.

CMS’s 2027 guidance distinguishes these from calls that don’t involve marketing, sales, or enrollment, which aren’t subject to this requirement. CMS’s training material also continues to address required TPMO disclosures, including the number of organizations an agent represents and the products the agent sells.

For agents, the lesson is don’t let easier appointment scheduling lead to looser documentation habits.

The Sales Conversation Still Needs to Be About the Beneficiary

Compliance isn’t just paperwork. Before beginning the enrollment process, CMS requires agents and brokers to discuss a defined set of beneficiary-specific considerations.

That includes questions about:

  • Preferred doctors and specialists
  • Hospitals and other facilities
  • Pharmacy networks
  • Prescription formularies
  • Premiums and cost sharing
  • Dental, vision and hearing needs
  • Durable medical equipment and other healthcare needs

Agents should also review deductibles, copays, and coinsurance rather than focusing solely on a single appealing benefit or premium. This approach supports both compliance and good sales practice.

A plan isn’t useful simply because one benefit sounds great. It has to work with the beneficiary’s actual providers, prescriptions, budget, and healthcare needs.

Training and Testing Still Matter

CMS continues to require organizations and TPMOs to ensure agents and brokers selling Medicare products on their behalf are trained and tested annually on Medicare rules and regulations as well as the specific benefits of the plans they sell. That means agents shouldn’t assume last year’s knowledge is enough.

The 2027 guidance specifically incorporates the new appointment and event rules into the topics organizations are expected to address in training.

More Flexibility Doesn’t Mean Less Responsibility

The direction for 2027 is clear. CMS has removed some friction from the agent-beneficiary relationship.

The 48-hour SOA waiting period is gone. Educational events have more flexibility.

Beneficiaries can move into conversations with licensed agents more naturally when they want help. CMS specifically described its 2027 changes as removing restrictions on the “time and manner” in which beneficiaries have conversations with licensed agents and brokers.

The primary expectations of CMS are for agents to document each interaction, understand the beneficiary’s needs, explain the plan clearly, and follow the required sales process. Agents should review their workflows now before the busy AEP period starts.

CMS’s updates to the SOA collection procedures, call-recording practices, event processes, and pre-enrollment conversations make 2027 compliance a useful framework to help beneficiaries make informed Medicare decisions.
