Another lawsuit is coming for CMS and its 2027 ACA Final Rule. A coalition of 21 states is suing CMS about the 2027 CMS ACA Final Rule in Northern California.
This lawsuit raises the same issues that a federal Maryland judge addressed in a June order blocking 8 provisions of the 2027 CMS ACA Final Rule. This additional lawsuit provides another broader route to block these provisions from going into effect in more parts of the nation.
It’s unknown at this point what the next steps of the new lawsuit will be, and how it’ll impact the upcoming 2027 OEP. Agility will continue to bring insurance agents the latest news about this topic, and all other insurance news, here on these pages.
